NATIONAL COMPANY LAW TRIBUNAL

The National Company Law Tribunal (NCLT) was instituted by the Central Government under the Companies Act, 2013, aiming for expedited case resolution and reducing multiple litigations across various forums. Established on June 1, 2016, it serves as a quasi-judicial body dedicated to adjudicating issues concerning Indian-registered companies.

The NCLT’s scope encompasses:

Consolidation of corporate jurisdiction from:

  • Company Law Board (CLB)
  • Board of Industrial and Financial Reconstruction (BIFR)
  • Appellate Authority for Industrial and Financial Reconstruction
  • High Courts’ powers related to company winding-up and other provisions

Additionally, the NCLT serves as an adjudicating authority for insolvency resolution processes of companies and Limited Liability Partnerships under the Insolvency and Bankruptcy Code, 2016.

The National Company Law Appellate Tribunal (NCLAT), established under the Companies Act, 2013, acts as an appellate body for appeals against NCLT and Insolvency and Bankruptcy Board of India orders, with exclusive jurisdiction shared with NCLT.

Parties appearing before the NCLT and NCLAT may be represented by Chartered Accountants, Company Secretaries, Cost Accountants, Legal Practitioners, or other authorised individuals.
